General terms and conditions
Home / Terms and Conditions
These terms apply to contracts between Argoa GmbH, Neulweg 1, 86453 Dasing, Germany, and its customers. Argoa GmbH is registered with the local court of Augsburg under HRB 31176 and represented by its managing director, Stefan Buza. VAT ID: DE310153746. Telephone: +49 8251 9369040. Email: info@argoa.de.
1. Scope and definitions
These terms apply in the version in force when you place your order. Different terms proposed by a customer apply only if we expressly agree to them in writing.
You are a consumer if you order mainly for purposes outside your trade, business or profession. A business customer is a natural or legal person, or a partnership with legal capacity, acting in the course of their trade, business or profession.
2. Placing an order and concluding the contract
You can add products to your basket and review or change your order details before submitting them. By accepting these terms and clicking the final order button, which clearly indicates an obligation to pay, you make a binding offer to buy the products in your basket.
We send an automatic email confirming receipt of your order. This acknowledges that we have received your order; it does not yet mean that we have accepted it. The contract is concluded when we accept your order in a separate order-confirmation email. We send the contract details, including your order, these terms and our acceptance, by email or on paper no later than delivery. We retain the contract information in accordance with our privacy policy.
The contract language is German.
3. Delivery and availability
Delivery times run from our order confirmation, provided that payment has been received where advance payment is required. If the product page does not state a different delivery time, the delivery time is three days.
If an ordered product is unavailable, we inform you promptly. If it is permanently unavailable, we do not accept the order for that product and no contract is concluded for it. We also inform you promptly if a product is temporarily unavailable.
We deliver to addresses in Germany, Austria, Belgium, Croatia, Czechia, Denmark, Finland, France, Greece, Hungary, Italy, Luxembourg, the Netherlands, Poland, Slovenia, Spain and Sweden. Special shipping conditions apply to Corsica, the Balearic Islands and the Dutch Wadden Islands. We do not deliver to the Canary Islands, Ceuta or Melilla. The shipping charges and any delivery restrictions for your address are shown under Shipping and payment and during checkout before you place your order.
4. Ownership
The goods remain our property until they have been paid for in full.
5. Prices and shipping charges
Consumer prices include the applicable VAT. Shipping charges and free-delivery thresholds depend on the destination country and, where applicable, the delivery region. The current amounts are listed under Shipping and payment. Free-delivery thresholds are based on the value of the goods including VAT, after discounts and excluding shipping charges. The charge for your order is shown separately before you place it.
We bear the shipping risk for deliveries to consumers. Refunds of delivery charges and the costs of returning goods when you exercise your right of withdrawal are explained in section 9.
6. Payment
You can use the payment methods offered for your order at checkout. The available methods and any specific payment terms are shown before you place your order. Payment is due when the contract is concluded unless a different due date is agreed for the selected payment method or for your order.
You can manage saved payment methods using the functions available in your customer account. Removing a saved payment method does not cancel an order or subscription.
If you are in default of payment under the applicable statutory rules, interest is payable at the statutory rate. For consumers, this is five percentage points above the base rate per year. Our right to claim further loss caused by late payment remains unaffected.
7. Defects and guarantees
Your statutory rights if goods are defective apply, including the rights set out in sections 434 onwards of the German Civil Code (BGB). For business customers, the existing twelve-month warranty period applies subject to the applicable B2B terms and mandatory law. This limitation does not apply to consumers.
An additional commercial guarantee applies only if we expressly provide one for the product. Such a guarantee does not affect your statutory rights.
8. Liability
Claims for damages are excluded except for claims arising from injury to life, body or health, breach of an essential contractual obligation, or intentional or grossly negligent conduct by us, our legal representatives or persons acting on our behalf. Essential obligations are those needed to achieve the purpose of the contract.
For a breach of an essential contractual obligation caused by ordinary negligence, liability is limited to the foreseeable loss typical of the contract. This limitation does not apply to injury to life, body or health.
These limitations also apply to claims made directly against our legal representatives or persons acting on our behalf. They do not apply where we fraudulently conceal a defect, give a guarantee regarding the quality of the goods, or agree specific characteristics with you. Liability under the German Product Liability Act remains unaffected.
9. Your right of withdrawal
Consumers have a statutory right to withdraw from a distance contract. You can withdraw from this contract within fourteen days without giving a reason.
The withdrawal period ends fourteen days after you, or a third party you nominate other than the carrier, receive the goods. If goods ordered together are delivered separately, the period starts when the last item is received. For a contract for regular deliveries of goods over a defined period, it starts when the first delivery is received.
To withdraw, inform Argoa GmbH, Neulweg 1, 86453 Dasing, Germany, telephone +49 8251 9369040, email info@argoa.de, of your decision by a clear statement, for example by post or email. You may use the model form below, but you do not have to.
You can also use the Withdraw from contract function available on this website. Send your withdrawal statement before the fourteen-day period ends to meet the deadline.
What happens after withdrawal
We refund all payments received from you, including the cost of our least expensive standard delivery. Extra charges for a more expensive delivery method you chose are not refunded. We make the refund without undue delay and no later than fourteen days after receiving your withdrawal statement, using the same payment method unless you expressly agree otherwise. We do not charge a refund fee.
We may withhold the refund until we receive the goods back or you provide evidence that you have sent them back, whichever happens first.
Send or return the goods to Argoa GmbH, Neulweg 1, 86453 Dasing, Germany, without undue delay and no later than fourteen days after telling us that you are withdrawing. You meet this deadline if you send the goods before the fourteen days end. You pay the direct cost of returning the goods.
You are responsible for any loss in value only if it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Complete and send this form only if you wish to withdraw from the contract.

10. Applicable law and remaining provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice does not deprive consumers of mandatory protection under the law of the country where they normally live.
Where the customer is a merchant, a legal person under public law or a special fund under public law, the agreed place of jurisdiction is our registered office, to the extent permitted by law. This clause does not establish an exclusive place of jurisdiction for consumers.
If an individual provision is invalid, the remaining contract continues to apply. The applicable statutory rules replace the invalid provision. If continuing the contract would cause unreasonable hardship to a party, the contract is invalid as a whole.
